Canadian prodco Nerd Corps Entertainment’s distribution arm is suing Denmark-based licensing and brand management agency Kidz Entertainment for approximately US$267,300 plus damages.

According to the writ filed on January 20, 2009 with the Supreme Court of British Columbia in Vancouver, Nerd Corps is alleging that Kidz agreed to pay €202,800 (approximately US$267,300) in exchange for the delivery of 26 episodes of its boys action series Storm Hawks and marketing/licensing activity around the property in Denmark, Finland, Sweden, Norway and Iceland.

The writ further states that Nerd Corps delivered the 26 episodes on January 14, 2008, rendering three invoices for the agreed fee and ‘despite demand for payment, the Defendant [Kidz] has failed or refused to pay.’ Also at issue is Kidz alleged failure to perform ‘Additonal Obligations under the agreement’ as they pertained to marketing, distribution and licensing of Storm Hawks in the Nordic region.

Nerd Corps is seeking the outstanding fee and general damages. When reached this morning, Nerd Corps president Ken Faier said he was currently in ‘productive discussions with the principals of Kidz Entertainment’ and was optimistic that the matter would be resolved shortly.

For its part, Kidz Entertainment’s Claus Tomming responded with the following: ‘News of Nerd Corp Entertainment’s legal action against us with regards to Storm Hawks has come completely out of the blue. We can say little at this time except that we have enjoyed a positive and productive relationship with them to this point and it is our intent to continue to do so going forward.’
